§1 Provider and Scope
(1) The provider and contractual partner for orders placed through this online store is:

(2) These Terms of Service apply to all contracts concluded between morphano GmbH and consumers via this online store.
(3) A consumer within the meaning of these Terms of Service is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.
§2 Conclusion of Contract
(1) The presentation of products in the online store does not constitute a legally binding offer, but a non-binding invitation to place an order.
(2) By clicking the button “Pay now”, “Complete order”, “Buy now”, or any other equivalent checkout button used in this store, you submit a binding offer to purchase the goods contained in the shopping cart.
(3) The contract is concluded when we accept your order by means of an express order confirmation sent by email or by dispatching the goods.
(4) We store the contract text. The order details and these Terms of Service will be sent to you by email. If you have created a customer account, you may also view past orders in your account.
(5) The contract language is English.
§3 Prices and Payment Terms
(1) All prices are final prices and include applicable statutory value-added tax.
(2) Shipping costs may apply in addition to the stated prices. These will be shown separately during the ordering process.
(3) Payment can be made using the payment methods offered in the online store, in particular:

- PayPal
(4) The purchase price is due immediately upon conclusion of the contract.
§4 Delivery and Transfer of Risk
(1) Delivery will be made to the delivery address specified by the customer.
(2) Delivery times are indicated in the online store. Unless otherwise stated, delivery within Germany takes 1–2 business days.
(3) In the case of consumers, the risk of accidental loss or accidental deterioration of the goods passes only when the goods are handed over to the customer or to a third party designated by the customer.
§5 Retention of Title
The goods remain our property until full payment has been received.
§6 Right of Withdrawal
Consumers have a statutory right of withdrawal.
Details are set out in the separate Withdrawal Policy.
§7 Warranty
The statutory warranty rights shall apply.
§8 Liability
(1) We shall be liable without limitation for damages resulting from injury to life, body or health caused by an intentional or negligent breach of duty on our part.
(2) We shall only be liable for other damages in cases of intent and gross negligence.
(3) In cases of ordinary negligence, we shall only be liable for the breach of essential contractual obligations (cardinal obligations). In this case, liability shall be limited to the foreseeable damage typical for the contract.
(4) Liability under the German Product Liability Act remains unaffected.
§9 Information on Food Supplements
(1) The products offered are food supplements. They are not intended to diagnose, treat, cure or prevent any disease.
(2) Food supplements are not a substitute for a balanced and varied diet and a healthy lifestyle.
(3) The recommended daily intake must not be exceeded.
(4) The products must be kept out of the reach of young children.
§10 Dispute Resolution
We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
§11 Applicable Law
The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the country in which the consumer has their habitual residence.
§12 Final Provisions
Should any provision of these Terms of Service be invalid in whole or in part, the validity of the remaining provisions shall remain unaffected.
